PickMarket – Terms & Conditions (End-User License Agreement)

1. Acknowledgement
This End-User License Agreement (“EULA”) is concluded between you and PickMarket LLC only, and not with Apple. PickMarket LLC is solely responsible for the Licensed Application and its content. Your use of PickMarket must also comply with the Apple Media Services Terms and Conditions.
2. Scope of License
You are granted a limited, non-transferable license to use PickMarket on any Apple-branded products you own or control, subject to the Usage Rules in the Apple Media Services Terms and Conditions. This license also allows access by other accounts associated with the purchaser via Family Sharing or volume purchasing.
3. Maintenance and Support
PickMarket LLC is solely responsible for providing maintenance and support for the Licensed Application. Apple has no obligation whatsoever to provide any maintenance or support services with respect to PickMarket.
4. Warranty
PickMarket LLC is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. In the event of any failure of PickMarket to conform to any warranty, you may notify Apple, and Apple will refund the purchase price (if any) for PickMarket to you. To the maximum extent permitted by law, Apple will have no other warranty obligation whatsoever with respect to PickMarket. Any other claims, losses, liabilities, damages, costs or expenses attributable to any failure to conform to any warranty will be PickMarket LLC’s sole responsibility.
5. Product Claims
You and PickMarket LLC acknowledge that PickMarket LLC, not Apple, is responsible for addressing any claims relating to PickMarket or your possession and/or use of PickMarket, including: (i) product liability claims; (ii) claims that PickMarket fails to conform to legal or regulatory requirements; and (iii) claims arising under consumer protection, privacy, or similar legislation.
6. Intellectual Property Rights
In the event of any third-party claim that PickMarket or your possession and use of PickMarket infringes on intellectual property rights, PickMarket LLC, not Apple, will be solely responsible for investigating, defending, settling, and discharging any such claim.
7. Legal Compliance
By using PickMarket, you represent and warrant that (i) you are not located in a country subject to a U.S. Government embargo, or designated by the U.S. Government as a “terrorist supporting” country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.

9. Third Party Terms of Agreement
You must comply with all applicable third-party terms of agreement when using PickMarket. For example, you must not be in violation of your wireless data service agreement when using PickMarket.
10. Third Party Beneficiary
You and PickMarket LLC acknowledge and agree that Apple, and Apple’s subsidiaries, are third-party beneficiaries of this EULA. Upon your acceptance of this EULA, Apple will have the right (and will be deemed to have accepted the right) to enforce this EULA against you as a third-party beneficiary.
11. General Terms
These Terms are governed by the laws of Illinois, USA. Disputes will be resolved in the courts of Illinois. Continued use of PickMarket after updates means you accept the new Terms.
